The First: Free Speech at the Crossroads, a new PBS documentary co-hosted by NBC News senior correspondent Tom Costello and Colorado Public Radio journalist Bazi Kanani, gives a qualified answer to the question “Is the First Amendment in danger?” The film argues that the constitutional text remains in force, but particular freedoms, institutions and communities can face serious pressure from government decisions, political retaliation, private power and an unreliable information environment.
PBS lists the documentary as a 1-hour-27-minute program dated October 1, 2026, available through PBS and the PBS app. Its reporting moves from the amendment’s 1791 origins to current disputes over journalism, school books, religious practice and artificial-intelligence fakery.
What does The First: Free Speech at the Crossroads investigate?
The documentary treats the First Amendment as five connected freedoms rather than as a synonym for speech alone. Costello and Kanani follow the amendment’s history, explain why its protections matter, and ask whether political polarization, lawsuits, executive pressure, dark money and synthetic media are weakening the conditions in which those freedoms can be exercised.
Kanani describes the amendment in the trailer as “often misunderstood, often contested” and says that, for many Americans, it defines what freedom means. The film includes Pulitzer Prize-winning journalists Marty Baron and Dean Baquet, former CNN Pentagon correspondent Barbara Starr, Mary Beth Tinker, historians, activists and constitutional scholars.

The documentary’s central distinction comes from Baquet: “I don’t think the First Amendment itself is in danger. I would say there’s a subset that’s in danger.” In practical terms, that means separating the legal guarantee in the Constitution from the safety of reporters, students, religious minorities, protest movements and other people who rely on it.
What are the First Amendment’s five freedoms?
The National Archives’ transcription of the Bill of Rights records the amendment as ratified on December 15, 1791: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
| Freedom | What it protects | How the film uses it |
|---|---|---|
| Religion | Government may not establish or favor a religion, nor prohibit sincere religious exercise. | A current Supreme Court dispute involving religious practice tests how those principles operate. |
| Speech | Expression, including unpopular or dissenting views, is protected from impermissible government restriction. | The film examines political pressure, executive actions and manipulated online content. |
| Press | Journalists and news organizations receive protection against government abridgment of press freedom. | Lawsuits against news organizations and a reported White House exclusion of CNN, MS NOW and Politico over coverage disputes are presented as contemporary examples. |
| Peaceful assembly | People may gather nonviolently for political, religious or community purposes. | The documentary connects civic participation to the ability to challenge official decisions. |
| Petition | People may ask the government to correct grievances. | Petitioning appears as a route for turning disagreement into constitutional participation rather than intimidation. |
The amendment’s wording addresses Congress and, through later constitutional doctrine, government action. It does not automatically require a privately owned social network, employer, publisher or university to carry every message. That distinction is essential when assessing claims that a private moderation decision is itself a First Amendment violation.

Which historical events and court cases does the documentary revisit?
The film’s historical route starts with Thomas Jefferson and James Madison and the early republic’s argument over press freedom. It discusses the Alien and Sedition Acts, which made the danger of government punishment for criticism part of the nation’s constitutional memory, and the Espionage Act, whose later use in speech and press cases continues to raise difficult questions about national security and dissent.

Two landmark cases provide modern legal anchors. In Tinker v. Des Moines Independent Community School District, the Supreme Court recognized that students do not “shed their constitutional rights to freedom of speech or expression at the schoolhouse gate,” while still allowing schools to address substantial disruption. In New York Times v. Sullivan, the Court established the “actual malice” standard for public officials suing over allegedly defamatory reporting, a rule the film presents as central to a vigorous press.
These cases show why the amendment cannot be reduced to a simple permission to say anything anywhere. Rights depend on the government actor involved, the setting, the type of expression and the remedy being sought.
What current threats does the film put under the microscope?
The documentary presents several 2026 examples and attributes them to its reporting and interviews rather than treating them as permanent legal conclusions.

Its transcript discusses the reported September 2026 exclusion of CNN, MS NOW and Politico from the White House after coverage disputes. The constitutional question is whether official access and retaliation are being used to punish reporting or viewpoint.
- School book bans: Removing books from public-school libraries can involve government decision-making, student access to ideas and the educational setting addressed by cases such as Tinker. The legality depends on the stated reason for removal, the decision-maker and the governing jurisdiction.
- Religious practice: A Supreme Court dispute featured in the film asks how free exercise and the ban on government establishment should be applied when religious conduct meets public rules.
- Political polarization and money: The film asks whether concentrated political spending and increasingly adversarial politics distort who gets heard, who can obtain legal support and which grievances receive public attention. Those are civic and institutional pressures, not a claim that the amendment’s text has been repealed.
Why does artificial intelligence create a new First Amendment problem?
AI complicates the information ecosystem on which speech and press freedoms depend. The documentary shows a social-media video that appears to depict a tiger escaping its enclosure, then explains that the event never happened because the video was generated by AI. It also describes a fictional Instagram persona, Jessica Foster, presented as an army sergeant who attracted more than one million followers despite not being real.

Neither example means the First Amendment guarantees that online material is accurate. The amendment generally limits government censorship; it does not promise that speakers will be truthful, that audiences will identify fabrications or that platforms must distribute them. The practical challenge is to preserve robust expression while addressing fraud, impersonation, defamation, election manipulation and threats through lawful, narrowly tailored measures.
Costello’s NBCU Academy discussion links the film’s AI reporting to political polarization and journalists’ duty to inform the public. Verification, source disclosure, media literacy and transparent corrections become part of defending the conditions that make free expression meaningful, even though they are not themselves constitutional guarantees.
Is the First Amendment itself in danger, or are particular freedoms at risk?
The documentary’s answer is deliberately qualified. The constitutional text remains the governing standard, but enforcement can be weakened when officials retaliate against criticism, courts narrow remedies, institutions tolerate intimidation or citizens cannot distinguish authentic reporting from synthetic propaganda.
A useful way to evaluate any controversy is to ask three questions:

- Which freedom is involved? Identify religion, speech, press, assembly or petition instead of using “free speech” as a catch-all.
- Who is applying the pressure? A government order raises a direct constitutional issue; a private platform’s rule may raise a contractual, statutory or policy question instead.
- What response is available? Litigation, journalistic resistance, civic organizing, public-records work and education address different problems and can operate together.
That framework explains Baquet’s “subset” warning. A right can remain formally protected while the people and institutions exercising it become more vulnerable.

What should viewers take away?
The First is not a prediction that the First Amendment will suddenly disappear. It is a warning that constitutional language works through institutions, courts, journalists, schools, religious communities and ordinary citizens. Protecting the amendment therefore requires more than quoting its first words: it requires recognizing government retaliation, defending independent reporting, challenging unlawful restrictions and learning how to verify what appears on a screen.

Frequently Asked Questions
Does the First Amendment protect AI-generated lies or deepfakes?
There is no general constitutional right to have fabricated material treated as true. Government responses can still be limited by speech protections, so laws aimed at fraud, impersonation, defamation or election deception must be written and enforced within constitutional boundaries.
Can a public school remove a book without violating free speech?
Sometimes, but the reason matters. A school’s educational judgment, age-appropriateness decision or response to disruption is analyzed differently from removing a book solely to suppress a disfavored viewpoint; the governing facts and jurisdiction control.

Why does it matter whether a restriction comes from the government or a private company?
The First Amendment is principally a limit on government action. A private platform or employer may set its own rules, although other laws, contracts, public-accommodation requirements or state-action doctrines can create separate claims.
Is the documentary available outside the United States?
The researched listings confirm PBS and PBS-app availability, but they do not guarantee identical access in every country. International viewers should check the local PBS service or the program’s regional listing during the stated rights period.
